Statement made by Answar Ansari to police on 26th August 2010 (translated)

Affidavit

I,AnwarAnsari, s/o Asraf Ansari,R/o Babu Asariya , Mandora(Police Sattion0, Chhappra district, Bihar currently residing at c/o Ravindra Singh Yadav, Gali No: 11, Kapashera aged 31 years working in Viva Global, Plot No: 413, Udyog Vihar Phase III, Gurgaon, Haryana reached the factory gate to report to work at 9.30am as agreed among the management of Viva Global, the Garment and Allied Workers Union and the Labour department on 23rd August 2010 at the labour office. Around 15 gangsters came in a white Bolero with sticks, hockey sticks and pistols and started beating workers from Viva Global. One of the gangsters pointed to me and told others that ‘He is the number 1 leader and take him” . Other gangsters approached me and told me that “ Let the union do whatever it wants with direct workers. Do not instigate P&D contractor’s workers in Viva Global” And these gangsters started beating me with the stick and put me in the dickey of the white Bolero and drove away.

After around 1 hour 30 minutes, the vehicle was stopped and I was taken to an office in the ground floor and was beaten up with sticks and hand and was kicked by some of the gangsters. This went on for almost half an hour.

Then I was taken away to a bushy and water logged place. And the gangsters threatened me that “ You are going to leave the world now”. And the vehicle was roaming in the bushy area till evening. And the gangsters talked to some people on phone during this roaming and told me later that “Munchun was telling us that you are the main leader in Viva Global” (Munchun is the Personnel department staff in Viva Global) And I heard them taking the name of Sudhir’s( the General manager of Viva Gslobal) name also.

And late in the evening, I was taken to another room and was brought medicine for my heavy bruises and swellings. And one of the gangsters arranged to break my fast (He brought me apples and bananas). This gangster asked me where I stay and when i gave the address he recognised the nearby grocery storekeeper and told me that I know him and I go there as my friends stay there. Another gangster showed me an Identity card and said that “I was working in Police department before”

The gangsters brought papers and asked me to write that I am willing to resign the job whenever the company wants. When I told them that I am illiterate, the gangsters themselves wrote that ‘I will resign whenever the management asks me to do. And I will not create any trouble’ and was forced to copy that in another paper. And I was forced to sign a bunch of blank papers by these gangsters. And they snatched my union id card also.

And the gangsters closed my eyes with black cloth. After around 45 minutes driving, they
dumped me in Kapashera. On the way they told me that “if you bow yourself before owner of P&D contractor, your life will be spared” These gangsters threatened me when they dumped me in Kapashera at 10.45pm at night that “If your face is seen in Haryana, we will kill you”

I was threatened by the gangsters who kidnapped me that If I speak anything against them, I will be finished.

After 5-7 minutes of reaching my room, police came and took me to the police station. I was scared by these threats of gangsters and did not give the right affidavit to Police.

I hereby declared that the above mentioned statements are correct to the best my knowledge and belief and I know the consequences of making any wrong statements in the court.
